What the judge actually found
McHale's order concluded that Kalshi "operates an online betting platform" and misleads consumers by advertising its products as legal betting. The key legal holding is the same one now splitting courts nationwide: the Commodity Exchange Act, McHale wrote, regulates futures markets — not gambling — so it does not preempt Washington's Gambling Act.
