Is Kalshi legal in Nevada? The August 12 geofence, explained
If you are in Nevada and Kalshi's sports markets will not load for you, that is not a bug. It is a court order.

What the injunction actually bans
The May 18 order prohibits Kalshi from offering contracts on sports, election and entertainment outcomes to persons located within Nevada.

Between May 28 and June 1, 2026, Gaming Control Board investigators sat in Nevada and successfully bought prohibited event contracts on Kalshi eight times over four days.

What changed since August
No new state action as of October 14, 2026; the open items are a pending fine motion and a pending rehearing. The August 12 geofence deadline passed, and on August 14 the Gaming Control Board asked the First Judicial District Court in Carson City to impose the $120,000-a-day penalty, saying its investigators had placed nine prohibited trades on Kalshi's app from inside Nevada on August 13; Kalshi answered on August 15 that the investigators misrepresented their residence and used an older app version, and that its vendor GeoComply was state-approved (Gambling Insider, August 17). No ruling on that motion has been reported. On September 9 Kalshi petitioned the Ninth Circuit for rehearing en banc of the August 28 decision for Nevada (Prediction News, September 9); the petition is pending. The federal picture moved around Nevada: on September 16 the same circuit held in Blue Lake Rancheria v. Kalshi that sports contracts are Class III gaming on tribal land, on September 25 the Sixth Circuit ruled for Ohio and Tennessee, and on October 7 Nevada signed the 39-state amicus brief asking the Supreme Court to take New Jersey's case, No. 26-299 (brief, October 7). Kalshi's Supreme Court response is due November 9.
