Why the tribal claim is different

Every other state fight follows the same script: a gaming regulator says event contracts are wagers under state law, Kalshi answers that the Commodity Exchange Act preempts state gaming law, and a judge picks a side. The California case skips state law entirely.

The tribes argue that sports event contracts are Class III gaming under the Indian Gaming Regulatory Act, a federal statute. Class III gaming in California may only be offered under a tribal-state compact, and the tribes hold those compacts. Framed that way, the dispute becomes federal law against federal law rather than federal law against state law, which neutralizes Kalshi's strongest argument. It is the most structurally dangerous claim the company faces, which is why the Ninth Circuit appeal matters well beyond California.

The November 2025 denial was not a merits ruling. The court found the tribes had not met the demanding standard for emergency relief. Kalshi read it as vindication; the tribes read it as a scheduling setback. Both are somewhat right.

Why California is the biggest prize

California has roughly 39 million residents and no legal sportsbook. Every other large market that matters to prediction platforms — New York, New Jersey, Illinois, Pennsylvania — has regulated sports betting, which means event contracts compete with licensed operators there.
