Which Polymarket is in Wyoming
The Polymarket a Wyoming resident can use is Polymarket US, a dollar-denominated exchange run by QCX LLC. The CFTC designated QCX as a contract market on July 9, 2025, Polymarket acquired it later in 2025 and the product launched in December 2025. The original Polymarket, which settles in USDC on the Polygon blockchain, has been closed to US residents since the company’s January 2022 settlement with the CFTC. Everything below concerns the regulated US version; the offshore site is not legally available to anyone in Wyoming regardless of what the state does.
Polymarket US accepts customers at 18 and lists sports, politics, economics and culture markets. It is the entity New York sued on September 24, 2026 and one of the six operators Missouri’s Attorney General wrote to in September. Neither action touches Wyoming.
A small, young, 18-plus market
Wyoming legalised online sports betting with HB 133 in April 2021 and launched on September 1, 2021. The law is online-only, with retail wagering confined to the four tribal casinos, and it sets the minimum age at 18 rather than the 21 most states use. The Wyoming Gaming Commission licenses operators for $100,000 per five-year term, state law requires at least five licensees with no cap, and the tax is 10 percent of gross proceeds with the first $300,000 a year earmarked for problem-gambling treatment. Five books are live: DraftKings, FanDuel, BetMGM, Caesars and Fanatics.
The money is modest. In 2025 the operators took $234.4 million in bets, kept $26.4 million and paid the state $1.85 million in tax, according to Gaming Commission figures compiled by RG.org. That is the licensed market Polymarket US competes with without a licence or a tax bill, and it is small enough that the fiscal argument states like New York make, with its 51 percent tax rate, barely exists in Cheyenne.
The 18-plus floor matters for a specific reason. New York’s lawsuit against Polymarket leans on the fact that Polymarket US lets 18- to 20-year-olds trade while the state’s sports betting age is 21; Vermont, New Jersey and Massachusetts are also 21-plus states. In Wyoming a resident can open a DraftKings account and a Polymarket US account on the same eighteenth birthday. Whatever case Wyoming might one day make, underage access by the state’s own standard is not part of it.
What Wyoming has and has not done
Wyoming’s one public act is a signature. On October 7, 2026 Attorney General Keith Kautz joined the brief Ohio filed for 39 states and the District of Columbia in New Jersey v. Kalshi, Supreme Court docket 26-299, asking the Court to review the Third Circuit’s ruling for Kalshi. The brief is about Kalshi, but the question it asks, whether the Commodity Exchange Act preempts state gambling law for sports contracts on a CFTC-designated exchange, decides Polymarket US’s position in Wyoming just as directly.
What Wyoming did not do is also telling. When 41 attorneys general sent the CFTC a comment on April 30, 2026 arguing that the line between sportsbook bets and prediction-market bets is “illusory,” and naming Polymarket among the platforms, Wyoming was absent. The legislature’s Select Committee on Gaming spent its August and October 2026 meetings on online sweepstakes casinos, voting in October to sponsor a felony ban, and published accounts of both meetings do not mention event contracts, Polymarket or Kalshi. No bill on prediction markets is pending. Our Kalshi in Wyoming page has the detail on the committee and the sportsbook market.
The Tenth Circuit, where Utah’s case is
Wyoming shares its appeals court with Colorado, Kansas, New Mexico, Oklahoma and Utah, and Utah is where the precedent is being written. On August 4, 2026 U.S. District Judge Robert Shelby granted Utah summary judgment against Kalshi, holding that the CEA does not stop the state enforcing its anti-gambling laws. On September 8 the Tenth Circuit refused Kalshi an injunction pending appeal. On October 28 Utah filed 14 criminal counts against Kalshi and its co-founders, and on October 29 the CFTC and the Department of Justice sued Utah to halt the prosecution; Kalshi, DraftKings, FanDuel and Fanatics all pulled sports contracts from Utah within days. The merits appeal has not been decided, so there is no binding Tenth Circuit rule for Wyoming either way, but a circuit that has twice declined to shield Kalshi is not friendly ground for the preemption argument Polymarket relies on.
Polymarket US is not a party in Utah, and whether it still serves Utah customers is not clear from public reporting. If the Tenth Circuit affirms Shelby, every state in the circuit, Wyoming included, would have appellate cover to act against any CFTC-designated exchange offering sports contracts. Whether Wyoming would use it is a separate question, and nothing in its record suggests urgency.
The federal picture
Two federal moves bear on Wyoming without touching it. The CFTC’s impartial access interpretation of November 5, 2026 tells exchanges to stop blocking traders by US state within 30 days; Polymarket US has no court-ordered geofence anywhere, so the interpretation changes nothing for a Wyoming user, but it signals that the Commission would resist a Wyoming order if one came. And the Supreme Court’s handling of docket 26-299, on which Kalshi’s response is due in November, will decide whether the preemption question is settled nationally or left to the circuits, including the Tenth. Our analysis of the CFTC order explains how those two threads interact.
What this means in practice
A Wyoming resident today can open a Polymarket US account at 18 and a licensed sportsbook account at 18. Neither fact is a legal opinion. The first could change if the Tenth Circuit affirms Utah and Kautz decides to act, if the gaming committee turns from sweepstakes to event contracts, or if the Supreme Court rules for the states. Exchanges have geofenced states after orders were issued, so present access is not a guarantee of continued access. Every dated action is in the prediction market change log, and the current map is in the state tracker. For how Polymarket US and Kalshi differ in fees, see our fee calculator. Frequently asked questions
Is Polymarket legal in Wyoming?
Polymarket US operates in Wyoming and no publicly reported Wyoming cease-and-desist letter, lawsuit or regulatory finding targets it or Kalshi as of November 6, 2026. Wyoming sits in the Tenth Circuit, where Utah has beaten Kalshi at the district court and the appeals court has not ruled on the merits. That is the practical position, not a ruling by any Wyoming court.
Has Wyoming taken any position on prediction markets?
One. Attorney General Keith Kautz signed the 39-state Supreme Court brief of October 7, 2026 supporting New Jersey’s petition against Kalshi. Wyoming did not sign the 41-attorney-general comment to the CFTC of April 30, 2026 that named Polymarket, and its legislature’s gaming committee has focused on online sweepstakes.
Does Wyoming’s betting age matter for Polymarket?
It removes an argument. Wyoming’s licensed sportsbooks accept customers at 18, the same age Polymarket US and Kalshi use, so the under-21 access claim at the centre of New York’s lawsuit against Polymarket has no equivalent in Wyoming.
Which Polymarket is available in Wyoming?
Polymarket US, the dollar-denominated exchange run by QCX LLC, which the CFTC designated as a contract market on July 9, 2025. The original crypto-settled Polymarket has been closed to US residents since 2022.
Which federal circuit covers Wyoming?
The Tenth Circuit, with Colorado, Kansas, New Mexico, Oklahoma and Utah. A Utah federal judge granted the state summary judgment against Kalshi on August 4, 2026, the Tenth Circuit declined to block Utah’s enforcement on September 8, and Utah filed criminal charges against Kalshi on October 28. The merits appeal is pending.
