How West Virginia got here
March 2018. Senate Bill 415 is enacted, before the Supreme Court had even finished clearing the way nationally. West Virginia is among the first states to move.
August 2018. Retail sportsbooks open at the states licensed casino properties.
August 2019. Online betting launches. The regulated market reaches phones roughly four years before it did in several larger states.
July 2025. Senate Bill 576 takes effect, authorising fixed-odds wagering on horse and dog racing. The direction of travel is still expansion of the licensed market, not restriction.
Through 2026. No West Virginia action against Kalshi or Polymarket appears on the public record.
Why this state is the control case
Read the other state pages on this site and a pattern suggests itself. Mississippi has a geographic restriction the exchanges do not, so the gap looks like a licensing flaw. New Hampshire has a single operator paying 51 percent, so the gap looks like a monopoly problem. It is tempting to conclude that states with awkward market designs are the vulnerable ones.
West Virginia removes that excuse. It legalised early, went online early, licensed around nine competing operators, regulates through a single clear authority and has continued widening the legal market rather than protecting a narrow one. On every dimension it is the market design the industry asked for.
And the exchanges operate there on exactly the same terms as everywhere else, because their argument has nothing to do with how good a states regulated market is. The claim is that a sports event contract is a federally regulated financial instrument rather than a wager, which makes state gaming law the wrong rulebook entirely. A better state rulebook does not answer that.
The part worth watching
PrizePicks, a daily fantasy operator, has partnered with Kalshi to offer a prediction market product built on the exchange federally regulated status. That is the direction the pressure now runs: not just unlicensed exchanges competing with licensed books, but state-licensed operators routing products through a federal licence instead of a state one.
If that pattern spreads, the question for a state like West Virginia stops being whether to act against an outside exchange and becomes what to do when its own licensees start using someone else regulator. What this means in practice
A West Virginia resident today can open a Kalshi account and can also use any of the licensed sportsbooks operating in the state. Neither fact is a legal opinion, and the first could change on any business day if the Lottery Commission or the Attorney General decides to act, as eleven other states have. Kalshi has geofenced or withdrawn markets in states after orders were issued, so present access is not a guarantee of continued access.
