How Maine set it up
Maine legalised sports wagering and put mobile rights in one place: with the Passamaquoddy Tribe, the Penobscot Nation, the Houlton Band of Maliseet Indians and the Aroostook Band of Micmacs. The four tribes hold the exclusive right to offer mobile sportsbooks, which they exercise through commercial operating partners. Online betting went live in November 2023, regulated by the Maine Gambling Control Unit.
That structure has a history behind it. Maine tribal nations have long occupied a different legal position from tribes elsewhere in the country, and mobile wagering exclusivity was one of the mechanisms used to direct a new revenue stream toward the Wabanaki Nations rather than to national operators bidding for open licences.
The direction continued in January 2026, when Governor Janet Mills allowed LD 1164, An Act to Create Economic Opportunity for the Wabanaki Nations, to become law, authorising tribal governments to run online gambling platforms. No launch date has been set; regulators are still writing rules, and most projections point to late 2026 or early 2027.
Why this state is different from the others
Across the other state pages on this site, exclusivity tends to be a commercial artefact. New Hampshire licensed one sportsbook because a single bidder offered the state 51 percent. Mississippi kept betting on casino property because its casino industry preferred it that way. In both cases the restriction protects revenue.
Maine is not that. The restriction is the policy outcome the legislature was trying to achieve. The value of the licence is precisely that it is exclusive and precisely that it sits with named communities. Revenue routed elsewhere does not simply reduce a tax line; it erodes the mechanism itself.
An exchange operating under a CFTC designation does not need a Maine licence, does not bid for one, and does not participate in that arrangement at all. Its argument is that a sports event contract is a federally regulated financial instrument rather than a wager, which places it outside state gaming law entirely. That argument is indifferent to what the state was trying to accomplish with its licences.
There is an irony worth noting carefully. Federal preemption arguments have historically been a shield for tribal gaming against state interference. Here a federal framework is the reason a competitor does not have to engage with a state arrangement built for tribal benefit. The same structural logic, pointed the other way.

Maine sits in the First Circuit, which has not ruled on this question. States with a reported cease and desist or suit include Nevada, New Jersey, Maryland, Montana, Illinois, Ohio, Arizona, Tennessee, Massachusetts, New York and Connecticut. What this means in practice
A Maine resident today can open a Kalshi account and can also use the tribal mobile sportsbooks operating in the state. Neither fact is a legal opinion, and the first could change on any business day if Maine decides to act, as eleven other states have. Kalshi has geofenced or withdrawn markets in states after orders were issued, so present access is not a guarantee of continued access.
