Is Polymarket legal in Delaware?

Delaware is the Polymarket question with the clearest legal backdrop and the smallest local market. Every other state in this series is waiting to find out what its federal appeals court thinks. Delaware already knows, and the answer favours the exchanges, at least until the Supreme Court decides whether to take New Jersey’s petition.

Which Polymarket a Delawarean can use
There are two Polymarkets. The original polymarket.com settles in the USDC stablecoin and has been barred from serving US persons since the CFTC’s January 3, 2022 order against its operator, which carried a $1.4 million penalty. The product built for Americans is Polymarket US, which runs on QCX LLC, a designated contract market the CFTC approved on July 9, 2025 and allowed to take customers through intermediaries under an amended order in November 2025. It takes dollars, verifies identity, checks location and accepts users from 18. On October 27, Reuters reported that the CFTC is again examining whether Polymarket complied with the 2022 settlement, including its location controls; a probe is not a finding, and nothing in it is specific to Delaware. A lottery state with one app
Delaware runs sports betting as a lottery product. Its three racinos, Delaware Park, Bally’s Dover and Harrington, opened full sportsbooks on June 5, 2018, the first state outside Nevada to do so after the Supreme Court struck the federal ban. Mobile betting came later and in a single channel: Rush Street Interactive runs BetRivers under an exclusive contract with the Delaware Lottery, live since January 2024. The minimum age is 21 and the state keeps 50 percent of revenue.
The market is small. In 2025 Delaware’s sportsbooks took $253.3 million in bets, kept $20.7 million and paid $9.6 million to the state. A Polymarket US sports contract traded by a Delaware resident pays nothing into that system and is open to 18-year-olds, three years below the lottery’s floor. Those are the two arguments a Delaware regulator would make. Neither has been made in a letter.
Why the Third Circuit decides more here than anywhere else
Three federal appeals courts have now ruled on whether a state can apply its gambling law to sports event contracts on a CFTC-designated exchange. The Ninth Circuit ruled for Nevada on August 28, 2026 and the Sixth Circuit for Ohio and Tennessee on September 25. The Third Circuit went the other way on April 6, holding in Kalshi’s case against New Jersey that the Commodity Exchange Act likely preempts state sports betting law as applied to a designated exchange. That decision binds federal courts in Delaware.
The ruling was about Kalshi, but its reasoning turns on the federal status of the exchange, not on the company’s name. Polymarket US holds the same kind of designation. A Delaware official who sent it a cease-and-desist would likely face a preemption suit in Wilmington with the controlling precedent on the exchange’s side. That is the reverse of Ohio, where Polymarket US sued the state on October 16 inside the Sixth Circuit, which has already ruled against the exchanges.
The brief Delaware signed
On October 7, 2026, Ohio’s attorney general filed a brief for 39 states and the District of Columbia supporting New Jersey’s petition in Flaherty v. KalshiEX, No. 26-299. Delaware signed, as did Pennsylvania, the other Third Circuit state outside New Jersey. The brief asks the Supreme Court to take the case and, in substance, to reverse the precedent that protects exchanges inside Delaware. Kalshi’s response is due November 9. If the Court takes the case and rules for New Jersey, Delaware gains room to act against Kalshi and Polymarket alike; if it declines, the Third Circuit ruling stays the law in Delaware.
Where other states have gone after Polymarket
Polymarket US has drawn more state action than its position in Delaware suggests. Tennessee ordered it, Kalshi and Crypto.com to stop sports contracts on January 10, 2026. Rhode Island’s attorney general sued Kalshi and Polymarket on May 21. Kentucky sued Kalshi, Polymarket and VGW on June 17. New York’s attorney general sued Polymarket US on September 24. Missouri and Ohio sent it cease-and-desist letters in September and October, and Polymarket answered Ohio with a federal suit on October 16. None of those reaches Delaware; a state order binds only the state that issued it.
How Polymarket compares with Kalshi in Delaware
In practice the two are in the same place: available, unlicensed and untaxed by the state, untouched by enforcement, and protected by the same appellate precedent. Kalshi faces more litigation nationally and is the named party in the Supreme Court petition; Polymarket has been named in fewer suits but has sued a state itself. Since October 26 both are the NBA’s preferred prediction market exchanges, which affects marketing, not legal status. Their fees differ, and our fee comparison sets them out.
What this means in practice
A Delaware resident can open a Polymarket US account at 18 and trade sports, economic and political contracts, or place a sports bet with BetRivers or a racino at 21. What could change the first of those, in rough order of likelihood: a Supreme Court grant and ruling for New Jersey; a Delaware action that tests the Third Circuit precedent; or a change in Polymarket’s own availability. This describes current enforcement; it is not a legal opinion on whether trading is lawful.
Frequently asked questions
Is Polymarket legal in Delaware?
Polymarket US, the CFTC-regulated exchange run by QCX LLC, is available in Delaware and no Delaware order restricts it as of October 28, 2026. The state has sent no cease-and-desist and filed no lawsuit, and Delaware sits in the Third Circuit, which ruled in April 2026 that federal law likely preempts state sports betting law for a CFTC-designated exchange. That is the enforcement position, not a court ruling on Polymarket.
Can I use polymarket.com from Delaware?
No. The offshore site has been closed to US persons since the CFTC’s January 2022 order against its operator and geoblocks the United States. The product available to Delaware residents is the Polymarket US app.
Does Delaware have legal sports betting?
Yes. The Delaware Lottery runs sports betting at three racinos and through one mobile app, BetRivers, operated by Rush Street Interactive. The minimum age is 21 and the state keeps 50 percent of revenue.
Which court decides Polymarket’s status in Delaware?
The Third Circuit, which covers Delaware, New Jersey and Pennsylvania and ruled for Kalshi against New Jersey on April 6, 2026. A Supreme Court decision in New Jersey’s petition, No. 26-299, would override it.
