Which Polymarket is in Rhode Island
There are two Polymarkets, and only one of them is a defendant. The original site, polymarket.com, settles in the USDC stablecoin on the Polygon blockchain and has been barred from serving US persons since the CFTC's January 3, 2022 order against its operator, which carried a $1.4 million penalty. A Rhode Island resident who reaches it through a VPN is trading in breach of that order and the site's own terms. The product built for Americans is Polymarket US, which runs on QCX LLC, a designated contract market the CFTC approved on July 9, 2025 and that Polymarket's parent bought for $112 million; the Commission's filings page records it as "now operating under the assumed name of Polymarket US." It takes dollars, verifies identity with a government ID, a selfie and a Social Security number, checks location at sign-up, and accepts users from 18. Its sports taker fee is 5 percent of price times one minus price per contract, a maximum of 1.25 cents at 50 cents. The federal licence and the national map are in Is Polymarket legal in the US?; this page is about Rhode Island, where the entity named in the complaint is QCX LLC.
What the state filed, and why it filed against both
Neronha's complaint rests on the state constitution rather than on a gaming statute alone. Article VI, section 15 places lotteries under the General Assembly, and section 22 requires statewide and local referenda before any new type or location of gambling can open. Rhode Island voters approved sports betting at Twin River in 2016 and online wagering followed by statute in 2019, all of it run through the Rhode Island Lottery; nobody voted on event contracts. The suit asks the court to declare that sports event contracts are gambling within section 22, that they are casino gaming and online sports wagering subject to Lottery regulation and control, and that Kalshi and Polymarket US must stop offering them; it also seeks restitution and disgorgement. "There is no substantive difference between sports betting and 'events contracts' in this context," Neronha said in announcing it. "We demand Kalshi and Polymarket stand down, abide by our state laws, and disgorge their profits."
Most states have sued Kalshi alone, because it is the exchange with the largest retail footprint and the loudest preemption argument. Rhode Island named both for a reason its complaint makes explicit: it is protecting a revenue line, not a licensing principle. The state keeps 51 percent of online sports betting revenue under its contract, the highest share in the country, with 32 percent to the platform operator and 17 percent to Bally's retail book in Lincoln. The Lottery reported that sports wagers fell 8 percent from 2024 to 2025 as prediction markets grew, and the attorney general's office said sports betting had generated $2.8 billion for the state since 2019. A suit against one exchange would leave the other taking the same handle, which is why Polymarket US, with no Rhode Island presence beyond the app, is a defendant here and not in most other states.
Where the case is now
The procedural map is tangled and worth laying out. On May 21 Kalshi filed first, in the District of Rhode Island, naming Lottery director Mark Furcolo and other officials and asking for an injunction against enforcement (KalshiEX LLC v. Furcolo, No. 1:26-cv-00327). Hours later the state filed its Superior Court complaint against Kalshi and QCX. Within a week the United States and the CFTC moved to intervene on Kalshi's side, the first time the federal regulator had entered a state's prediction market case directly. The state agreed not to press its Superior Court action while the federal injunction motion was briefed, with the state's opposition due June 9. The state case was then removed to federal court as No. 1:26-cv-00333 and formally consolidated with Kalshi's, so that one judge, Chief Judge Mary S. McElroy, holds the exchange's preemption claim, the state's gambling claim and the federal government's intervention together. She heard argument on three preliminary injunction motions on August 3, 2026. As of October 21 there is no ruling on any of them, and nothing on the public docket since a September filing.
That silence matters more here than elsewhere. Rhode Island sits in the First Circuit, which has not decided whether sports event contracts are swaps under the Commodity Exchange Act or whether the Act preempts state gambling law. The Third Circuit said yes to both for Kalshi in New Jersey on April 6; the Ninth Circuit said no for Nevada on August 28 and the Sixth Circuit said no for Ohio and Tennessee on September 25. None of those opinions binds Judge McElroy, who can follow whichever she finds persuasive and whose decision would be the first step toward a First Circuit rule covering Massachusetts, Maine, New Hampshire and Puerto Rico as well. Above all of it, the Supreme Court has New Jersey's petition in Flaherty v. KalshiEX, No. 26-299, with Kalshi's response due November 9; a grant would likely freeze this case in place. The CFTC's October 9 rules, which excluded licensed casino and sportsbook bets from the swap definition and proposed to write event contracts into it, add an argument for the exchanges but do not decide the preemption question.
Polymarket US elsewhere, for comparison
Rhode Island's suit was unusual in May and is less so now. Nevada's Gaming Control Board obtained a preliminary injunction against Polymarket US on June 1, 2026, still the only court order anywhere requiring it to keep sports contracts away from a state's residents. Kentucky sued Polymarket US with Kalshi in June and is fighting to get the case back to state court. Baltimore sued QCX LLC and two affiliates on August 13 under the city's consumer protection ordinance. New York Attorney General Letitia James sued Polymarket US on September 24 under Executive Law 63(12); the company removed the case to federal court the same day. Ohio's Casino Control Commission sent it a cease-and-desist letter on October 2 with an October 16 deadline, and on October 16 Polymarket US sued Ohio's attorney general and the commission's executive director in the Southern District of Ohio, arguing that Ohio's licensing scheme violates the Commerce Clause and is preempted by the Commodity Exchange Act. Rhode Island was early; it is no longer alone.
What this means in practice
A Rhode Island resident can open a Polymarket US account at 18, verify their identity and trade sports, political and economic contracts in dollars, and can also bet legally with the Lottery's sportsbook at 18. The first fact changes if Judge McElroy grants the state's injunction, if the First Circuit or the Supreme Court rules for the states, or if Polymarket US decides, as it did in Nevada, to geofence a state where it has been ordered to. It also changes in the other direction if the court grants Kalshi's motion and the state is enjoined from enforcing, in which case Rhode Island would join New Jersey as a state where the exchanges operate under a federal order. Every dated action is in the prediction market change log, and the map for the other exchange is in the Kalshi legality tracker.

Frequently asked questions
Is Polymarket legal in Rhode Island?
Polymarket US, the CFTC-designated exchange run by QCX LLC, is available to Rhode Island residents and no court has ordered it to stop. But Rhode Island is one of the few states that has sued Polymarket by name: Attorney General Peter Neronha filed against Kalshi and Polymarket US in Superior Court on May 21, 2026, arguing their sports contracts are gambling that needs voter approval and Lottery control. The case was moved to federal court, argued on August 3, and had no ruling as of October 21, 2026. That is the practical position, not a court's answer.
What does Rhode Island's lawsuit ask for?
A declaration that sports event contracts are gambling subject to the referendum requirement in article VI, section 22 of the Rhode Island Constitution and are casino gaming and online sports wagering under the control of the Rhode Island Lottery; a permanent injunction against offering them in the state; and restitution and disgorgement of profits. The complaint says sports wagers in Rhode Island fell 8 percent from 2024 to 2025 as prediction markets grew.
Can I use polymarket.com from Rhode Island?
No. The offshore site has been closed to US persons since the CFTC's January 2022 settlement and geoblocks the United States. The product open to Rhode Island residents is the Polymarket US app, which requires identity verification, takes US dollars and accepts users from 18.
Which federal circuit covers Rhode Island, and what has it decided?
The First Circuit, which has not ruled on prediction markets. The Third Circuit sided with Kalshi in New Jersey in April 2026; the Ninth and Sixth Circuits sided with Nevada, Ohio and Tennessee in August and September. None of those bind the District of Rhode Island, which is why the consolidated case before Chief Judge Mary McElroy could produce the first First Circuit ruling. The Supreme Court has New Jersey's petition, No. 26-299, with Kalshi's response due November 9, 2026.
Is sports betting legal in Rhode Island?
Yes. Retail betting began in 2018 and online betting in 2019 through a single state-contracted platform under the Rhode Island Lottery; the state keeps 51 percent of online sports betting revenue, the highest share in the country. In May 2026 the Lottery picked Bally's to run a second online sportsbook.
